The Earth App ("we", "our", or "us") provides a platform for users to explore and learn about the world around them. By accessing or using our services, you agree to comply with and be bound by the following terms and conditions ("Terms of Service"). Please read these terms carefully before using our services.

1. General Provisions

The Earth App is subject to United States export, copyright, control, and criminal laws and regulations. You agree to comply with all applicable export control laws and regulations, including but not limited to the U.S. Export Administration Regulations and the U.S. International Traffic in Arms Regulations, as well as any applicable export control laws and regulations of other countries. You shall not export, re-export, or transfer any content, software, or technology obtained from our services in violation of any applicable export control laws and regulations. You are responsible for obtaining any necessary licenses or permissions required to export, re-export, or transfer content, software, or technology obtained from our services. We reserve the right to deny access to our services or to any content, software, or technology obtained from our services to any person or entity that we believe may be in violation of applicable export control laws and regulations. The Earth App is subject to Illinois (IL) jurisdiction, and any disputes arising out of or related to these Terms of Service or our services shall be resolved in accordance with IL and US law. By using our services, you consent to the exclusive jurisdiction and venue of courts located in the Cook County, Illinois for the resolution of any disputes arising out of or related to these Terms of Service or our services.

In the event of a class action lawsuit against us, you agree that you will not participate as a plaintiff or class member in any class action lawsuit against us. You agree that the only claims you may bring against us are individual claims, and you waive your right to bring any class action lawsuit against us. If a court determines that the waiver of class action rights is unenforceable, then you agree to resolve any disputes with us through arbitration on an individual basis, rather than in a class action, and you waive your right to participate in a class action lawsuit or class-wide arbitration against us. This Terms of Service is provided in English, AS IS, and we make no representations or warranties of any kind, express or implied, about the completeness, accuracy, reliability, suitability, or availability of the services or the information, products, services, or related graphics contained in the services for any purpose. Any reliance you place on such information is therefore strictly at your own risk. In no event will we be liable for any loss or damage including without limitation, indirect or consequential loss or damage, or any loss or damage whatsoever arising from loss of data or profits arising out of, or in connection with, the use of our services.

2. Acceptance of Terms

By using our services, you agree to be bound by these Terms of Service, as well as our Privacy Policy. If you do not agree to these terms, please do not use our services.

Advertising your own products, services, or content on our platform is not allowed without our prior written consent. Those with the consent of The Earth App may be allowed to advertise their own content, but must still adhere to all other guidelines and policies.

To comply with the Children's Online Privacy Protection Act (COPPA) and relevant international laws, we do not knowingly collect personal information from children under the age of 13, or the age of 16 in certain jurisdictions. Our services are not directed towards children, and we do not encourage children to use our services without parental consent. If we become aware that we have collected personal information from a child under the applicable age, we will take steps to delete that information as soon as possible. If you are a parent or guardian and believe that your child has provided us with personal information without your consent, please contact us at support@earth-app.com so that we can take appropriate action.

Administrators and moderators of our services are responsible for enforcing these Terms of Service and maintaining a safe and respectful environment for all users. They have the authority to remove content, issue warnings, and take other actions as necessary to enforce our policies. They also have permission to view all private information provided by users, including, but not limited to: email addresses, physical address, phone numbers, and any other personally identifiable information. You may opt to withhold this information on your profile. However, if you choose to provide it, you acknowledge and consent to administrators and moderators having access to this information for the purpose of enforcing our policies and ensuring the safety of our community. They have permission to access this information at any time, and may use it to contact you if necessary regarding your account or any content you have submitted. We take the privacy and security of our users' information seriously and have implemented measures to protect it. However, we cannot guarantee the absolute security of any information you provide to us, and you acknowledge and accept the risks associated with sharing personal information online.

3. User Conduct

You agree to use our services in a manner that is lawful, ethical, and respectful of others. You shall not engage in any activity that may harm, disrupt, or interfere with the proper functioning of our services or the experience of other users.

You shall not access our services through automated means (including bots, scrapers, or crawlers), attempt to bypass or interfere with rate limits, security measures, or authentication, or collect or harvest data from our services except as expressly permitted by these Terms of Service or through credentials we issue to you (see the Developer Access and API Keys section below). We may impose and enforce limits on the volume and frequency of requests to protect the stability and security of our services.

We provide tools to help keep our community safe. You may report content or other users that you believe violate these Terms of Service through the in-application reporting tools, selecting a reason such as hate speech, harassment, sexual content, violence, spam, misinformation, self-harm, illegal activity, or other concerns; some reports may be submitted without an account. You may also block other users to limit your interactions with them. You agree not to misuse these tools, including by submitting false, abusive, or repetitive reports. We review reports and may take action at our discretion. Violations of these Terms of Service may result in moderation actions tracked against your account, including strikes that accumulate over time and may lead to content removal, temporary suspension, or a permanent ban. You will generally be notified of moderation actions affecting your content or account, and you may appeal as described below.

Any photographs, writing, videos, or other content that you submit to our services ("User Content") must comply with our content guidelines and must not violate any applicable laws or regulations. You are solely responsible for the User Content you submit and must ensure that it does not infringe upon the rights of any third party, including intellectual property rights, privacy rights, and publicity rights. We reserve the right to remove any User Content that we deem inappropriate or in violation of our policies.

All content involving other persons must have the consent of those individuals before being submitted to our services. By submitting such content, you represent and warrant that you have obtained all necessary consents and permissions from the individuals depicted in the content. We reserve the right to remove any content that we believe may violate this requirement or that we deem inappropriate for our platform. Users may request removal of content involving themselves by contacting us at support@earth-app.com . If you fail to obtain the necessary consents and permissions for content involving other persons, you may be held liable for any resulting claims or damages. We encourage all users to respect the privacy and rights of others when submitting content to our services. You agree to indemnify and hold harmless The Earth App and its affiliates, officers, agents, and employees from any claim, demand, loss, liability, or expense arising out of or related to your violation of this requirement or your failure to obtain the necessary consents and permissions for content involving other persons, or any other violation of these Terms of Service.

In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have a process for responding to claims of copyright infringement. If you believe that your copyrighted work has been infringed upon through our services, you may submit a DMCA takedown notice to us at support@earth-app.com . Your notice must include the following information: (1) a physical or electronic signature of the copyright owner or a person authorized to act on their behalf; (2) identification of the copyrighted work claimed to have been infringed; (3) identification of the material that is claimed to be infringing and that is to be removed or access to which is to be disabled, along with information reasonably sufficient to permit us to locate the material; (4) your contact information, including your address, telephone number, and email address; (5) a statement that you have a good faith belief that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and (6) a statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner. We will review all DMCA takedown notices and take appropriate action as required by law.

We will keep a temporary record of all content submitted to our services, including User Content and AI-generated, even if it is publicly removed, for a period of 30 days. If you would like for it to be removed permanently in compliance with the General Data Protection Regulation (GDPR) or other applicable laws, or wish to appeal the removal of content, please contact us at support@earth-app.com with a valid explanation. We will review all permanent demands and appeals and may reinstate content if we determine that it was removed in error or if we receive additional information that changes our assessment. However, we reserve the right to uphold content removals if we believe they were justified based on our policies and guidelines. Failure to appeal content removals within 30 days may result in the permanent deletion of the content from our records. Content that is requested to be deleted permanently will be removed from our services and all associated records, and we will not retain any copies of the content after the deletion process is complete, except as required by law. We encourage all users to adhere to these Terms of Service and to respect the rights and privacy of others when submitting content to our services.

In addition to the temporary record described above, please be aware that some content is removed automatically over time as part of the normal operation of our services. For example, prompts, articles, and events are subject to limited lifespans and are deleted automatically after a period of time (for instance, shortly after a prompt is posted, after an article has been available for a period, or after an event has ended). These retention periods are approximate and may change as our services evolve. You should not rely on our services as a permanent store for your content, and we encourage you to keep your own copies of anything you wish to retain.

4. Intellectual Property

All content and materials provided through our services, including but not limited to text, graphics, logos, images, and software, are the property of The Earth App or its licensors and are protected by intellectual property laws. You may not use, reproduce, or distribute any content from our services without our prior written consent.

By submitting User Content to our services, you grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, and perform the User Content in connection with our services and our business operations. You also grant each user of our services a non-exclusive license to access your User Content through our services and to use it in accordance with the functionality of our services. This includes, but is not limited to, the right for users to view, share, and interact with your User Content as permitted by the features of our platform. You represent and warrant that you have all necessary rights and permissions to grant the above licenses for any User Content you submit, and that your User Content does not infringe upon the intellectual property rights of any third party. We reserve the right to remove any User Content that we believe may violate this requirement or that we deem inappropriate for our platform.

Users have the ability to set their accounts to "Unlisted" or "Private," which limits the visibility of their content to only those with whom they choose to share it. If you set your account to "Unlisted," your content will not be discoverable through search or browsing features, but can still be accessed by anyone with the direct link. If you set your account to "Private," your content will only be visible to users you have approved as followers, and will not be accessible to anyone else. In addition, provided content like names, email addresses, and phone numbers can also be set to "Private," "Public," "Mutual," or "Circle," which controls who can see that information on your profile. We respect users' privacy settings and will not share or disclose content that is set to "Unlisted" or "Private" without your consent, except as required by law or to protect our rights. Use of user content for advertising purposes as described above will be omitted for content from accounts set to "Unlisted" or "Private." We do not guarantee the security of any content you choose to share on our platform, and you acknowledge and accept the risks associated with sharing content online, even if it is set to "Unlisted" or "Private." We encourage all users to carefully consider the content they share and to use our privacy settings to control who can see their content.

Accounts found in violation of any section of these Terms of Service may be subject to penalties, including but not limited to content removal, account suspension, or permanent banning. We reserve the right to take any action we deem necessary to enforce our policies and maintain a safe and respectful environment for all users. If you believe that your account has been unfairly penalized, you may contact us at support@earth-app.com with an explanation of the situation. We will review all appeals and may reinstate accounts if we determine that they were penalized in error or if we receive additional information that changes our assessment. However, we reserve the right to uphold penalties if we believe they were justified based on our policies and guidelines. We encourage all users to adhere to these Terms of Service and to respect the rights and privacy of others when using our services.

5. Developer Access and API Keys

We may allow you to create API keys for programmatic access to our services. You are responsible for keeping your API keys confidential and for all activity that occurs under them. You must use API keys only within the scopes and permissions granted, must not share them or use them on behalf of others without authorization, and must comply with any rate limits and usage restrictions we set. We may log information associated with API key usage, such as the time of use and the originating IP address, for security and abuse-prevention purposes. We may suspend, revoke, or expire API keys at any time, and API keys are automatically revoked if your account is disabled or banned. Any use of our services through automated means is governed by the User Conduct section above, and we reserve the right to revoke access for any use that we determine to be abusive, excessive, or otherwise in violation of these Terms of Service.

6. Mobile Applications and Quests

Our mobile applications and certain features, particularly quests, may request access to capabilities and data on your device, including your location (including background location while a distance-based quest is active), camera, microphone, motion and activity sensors, health and fitness data (such as step or workout information), and the ability to send you push notifications. We request these permissions only to provide the relevant features, and you may grant or revoke them at any time through your device settings; some features may not function without the necessary permissions. By participating in quests or using these features, you consent to our collection and use of the associated data as described in our Privacy Policy. You are responsible for using location-based and physical-activity features safely, for remaining aware of your surroundings, and for complying with all applicable laws; you participate in any physical activity associated with our services at your own risk. Your use of our mobile applications is also subject to the terms and policies of the applicable app store or platform.

7. Subscriptions and Billing

The Earth App offers optional paid subscriptions that unlock additional features and higher account tiers. Our paid tiers are Pro, Writer, and Organizer, offered as monthly plans and charged in United States dollars at the price shown to you at checkout (currently $5.99 per month for Pro, $8.99 per month for Writer, and $14.99 per month for Organizer, plus any applicable taxes). The free tier remains available at no cost and does not require a payment method. When you purchase a subscription, you authorize us and our payment processor to charge your chosen payment method the recurring subscription fee, together with any applicable taxes, at the start of each billing period. Subscriptions purchased on our website are processed by Stripe; subscriptions purchased through our mobile applications are processed by the Apple App Store or Google Play. You are responsible for keeping your payment information accurate and up to date. Your subscription grants you a personal, non-transferable right to access the features of your tier for as long as your subscription remains active. These billing terms are part of these Terms of Service and should be read together with our Refund Policy.

8. Auto-Renewal and Express Consent

Paid subscriptions are auto-renewing continuous-service (negative option) subscriptions. Before you are charged, we clearly and conspicuously disclose the subscription's material terms (the tier, the recurring price, the monthly billing frequency, the fact that the subscription automatically renews until you cancel, and how to cancel), and we obtain your express, affirmative consent to those terms (for example, by asking you to check a box or confirm a dialog that is separate from any other terms). We do not pre-check that consent for you, and we do not enroll you in auto-renewal without it. We record the date and time of your consent and retain that record for at least three years, consistent with the United States Restore Online Shoppers' Confidence Act (ROSCA), the California Automatic Renewal Law, and similar laws. Unless and until you cancel, your subscription will automatically renew at the end of each monthly billing period, and your payment method will be charged the then-current price for the next period. You may cancel at any time as described in the next section.

9. One-Click Cancellation (Web and In-App)

You can cancel your subscription at any time, easily and without penalty. Cancellation is available online through your account's billing settings on our website and, for subscriptions managed by us, directly inside our mobile application through an in-app cancel control, in keeping with New York General Business Law Section 527-a, Quebec's Consumer Protection Act, and similar requirements. Canceling takes no more steps than it took to subscribe: we do not require you to call us, chat with an agent, mail a letter, or complete a retention process, and we will not obstruct your cancellation. When you cancel, you keep access to your paid features until the end of the billing period you have already paid for, and you will not be charged again. We do not claw back the remaining days of a period you cancel outside the money-back window, because your paid access simply continues to the end of that period. We confirm your cancellation by email and in the app. If you purchased through the Apple App Store or Google Play, you cancel through that store's subscription settings, and we surface a link to the correct place (see the Mobile Store Purchases section below).

10. Refunds and 14-Day Money-Back Guarantee

We offer a universal 14-day money-back guarantee. If you are not satisfied, you may request a full refund of any subscription charge within 14 days of that charge, both for your first purchase and for every renewal. This guarantee supersedes any shorter refund window that might otherwise apply, and it is offered in addition to the statutory rights described in the next section. To use it, cancel within the 14-day window (a cancellation inside the window is processed as a full refund, and your tier returns to free) or contact us at support@earth-app.com. Refunds are issued to your original payment method. For subscriptions billed by the Apple App Store or Google Play, refunds are handled by the applicable store; we will help you request one and honor the spirit of this guarantee to the extent the store allows. 11. EU and UK Statutory Withdrawal Rights

If you are a consumer in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from your purchase within 14 days without giving any reason, under the EU Consumer Rights Directive (2011/83/EU) and the UK Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. To withdraw, tell us your decision by a clear statement before the 14-day period ends (for example, by emailing support@earth-app.com; you may use the model withdrawal form but are not required to). If you withdraw in time, we refund all payments received for the withdrawn subscription, without undue delay and no later than 14 days after we are informed, using the same payment method you used. Although we can begin providing a paid subscription immediately at your request during the withdrawal period, we do not deduct any amount for your use of the service before you withdraw, and we do not ask you to waive your withdrawal right; our 14-day money-back guarantee is designed to match or exceed these statutory protections.

12. Price Changes

We may change subscription prices from time to time. If a price increase would affect your subscription, we will give you advance notice before the new price takes effect, sent on a schedule of roughly 30 days, 7 days, and 1 day beforehand, with a confirmation at the time of the first charge at the new price. Because this notice is a required part of your subscription, it is a transactional message that you cannot unsubscribe from while you hold a paid subscription, and it does not replace any optional marketing email you have chosen to receive. A price change never applies retroactively; it applies only to billing periods that renew on or after its effective date. You may cancel at any time before the new price takes effect if you do not accept it, and if you keep your subscription after the effective date, the new price applies to your next renewal.

13. Free-Trial Codes

We sometimes offer free-trial codes that unlock a paid tier for a limited time. Trial codes never require a credit card, and they do not convert into a paid subscription or charge you anything when they end. When a trial from a code ends, your account simply returns to the free tier unless you separately choose to subscribe. Trial codes may be limited in how many times they can be redeemed, may expire, are limited to one redemption per account, are non-transferable, and have no cash value. A trial code cannot be redeemed on an account that already has an active paid subscription. We may deactivate a code that is expired, fully redeemed, or being misused. Because a trial code never places a charge, there is nothing to refund when it ends.

14. Mobile Store Purchases

If you buy a subscription inside our iOS or Android application, the purchase is processed, billed, managed, renewed, cancelled, and refunded by the Apple App Store or Google Play under that store's terms, not by us directly. To change or cancel a store-billed subscription, or to request a refund for one, use the subscription settings of the applicable store; our application provides a link to the right place. Store auto-renewal, free-trial, and refund rules are set by Apple and Google, and their refund handling may differ from a purchase made on our website; where a store declines a refund, we will do what we can to honor our money-back guarantee through other means. You may hold only one active Earth App subscription at a time, so you cannot stack a store subscription on top of a web subscription; if you already subscribe through one provider, cancel it before subscribing through another.

15. Chargebacks and Disputes

Because we offer a generous, no-questions 14-day money-back guarantee and easy one-click cancellation, please contact us at support@earth-app.com before disputing a charge with your bank or card issuer, so we can resolve it quickly, usually with an immediate refund. Nothing in these Terms of Service limits any rights you may have under the United States Fair Credit Billing Act or similar laws to dispute billing errors with your card issuer. We reserve the right to investigate chargebacks, to provide transaction records to the payment processor or issuer, and, in cases of fraud or abuse (for example, a chargeback filed after extended use with no attempt to contact us), to suspend or limit the associated account. We will not penalize a good-faith dispute or a legitimate billing-error claim.

16. Governing Law

The governing-law, venue, and dispute-resolution provisions in Section 1 apply to these subscription and billing terms. However, if you are a consumer, nothing in these Terms of Service removes or reduces the mandatory rights and protections you have under the consumer-protection laws of the country, state, or province where you live, and those laws continue to apply to you regardless of the choice of law in Section 1. This includes, where applicable, the California Automatic Renewal Law, New York General Business Law Section 527-a, the Colorado, Minnesota, Utah, and Virginia automatic-renewal laws, the EU Consumer Rights Directive and UK Consumer Contracts Regulations, and Quebec's Consumer Protection Act. Where any billing term in these Terms of Service conflicts with a non-waivable protection that applies to you, that protection controls, and the rest of these terms continue in effect.

17. Limitation of Liability

To the fullest extent permitted by law, The Earth App shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services.

The application allows users to submit their own content, and we do not endorse or take responsibility for any user-generated content. Users are solely responsible for the content they submit and must ensure that it does not violate any applicable laws or regulations. We reserve the right to remove any user-generated content that we deem inappropriate or in violation of our policies.

In addition to user-generated content, our services may include AI-generated content. The parameters for generating this content are determined by us, and we do not guarantee the accuracy, reliability, or appropriateness of any AI-generated content. Users should exercise caution and discretion when interacting with AI-generated content and should not rely on it for critical decisions or actions. In addition, we reserve the right to remove or modify any AI-generated content that we deem inappropriate or in violation of our policies.

18. Changes to Terms

We reserve the right to modify or update these Terms of Service at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after any such changes constitutes your acceptance of the new terms. We will endeavor to notify users of significant changes to these Terms of Service through our website or other communication channels. It is your responsibility to review these Terms of Service periodically to stay informed about any updates or changes. If you do not agree to the updated terms, please discontinue use of our services.
